POLL: chances of me getting terminated.

So, I guess D and I have decided it's not worth me working anymore in my current situation. So I'm going to put in my two weeks notice. Small recap of situation: I basically work for two days and end up back in the hospital, and then ordered out for 2 to 3 days each time I go in or am seen by a doctor. Basically we are losing money with me "working". So, I will be putting in my two weeks. Thinking they might just go ahead and fire me on the spot.

Depends on where you work... If you feel it's necessary....Submit your two week notice and tell them to feel free not to schedule you for those two weeks... At Andy's, my daughter submitted her two weeks notice and the supervisor immediately walked over to the schedule and erased her off the schedule so she was basically fired... You can't/shouldn't work because of your health, submit the resignation and technically they cannot "fire" you...because you resigned first.

Your health is more important. Put in the two weeks notice and let fate take it's course. If they do fire you can't you apply for unemployment?

If you are fired or resign, you do not qualify for unemployment. You have to be laid off....

Well, wouldn't it be a lay off versus a firing? I think getting fired is when you do something wrong and getting laid off means they don't need you anymore.

I got unemployment and I was terminated after i put in my resignation....

If they do fire you can't you apply for unemployment? I was told if you are terminated from a job and the company signs off for the unemployment compensation you get paid. Don't know the exact truth behind that tho.

I would think they wouldn't try anything too slick, because they have been awesome with everything so far, but you just never know they might do it as a favor to "help me out" knowing how sick I have been. wondering will I get payment for my sick leave in the "bank" or does that disapear too?

If you are fired or resign, you do not qualify for unemployment. You have to be laid off Not in all cases, I was able to get unemployment once and I was not laid off! It was a bad situation why I was let go from a job, unemployment sided with me and the company didn't fight it. Tada I got paid. :) All just depends on the details of the situation.

So, I was asked if I would like to stay on part time and have more of a desk job position, and told they don't want to lose me. That they would allow me a few days to decide if I want to do that vs giving them my 2 weeks. I was also asked if I actually wanted to work the two weeks or just stop as is.

kinda like i said.... submit the notice and tell them that if they need to take you off the schedule they can.... Sounds like you have a nice place to work. I would take the accommodations if you think you can handle it and need to work.....

Adah's childcare amount still won't change so after that and gas I would only be bringing in about $120 extra income a week. I'll let my hubby decide if that amount is worth it to him. Which I would assume with their offer of part time and desk setting it would have to improve me going to the hospital, but if not then I will be in the same boat. And last nights trip to the ER they gave me morphine which obviously made me unable to drive and then I was there past the time adahs childcare is open (which is all fine and dandy when D is in town, but with him leaving for work ups would put me in a bad situation) So, that's another reason we really have to look into it before deciding.

They won't fire you if you put in your notice. That's actually illegal. They might cut your hours pretty drastically but that's it. On a side note, if you get out of the military, even with an honorable discharge or med board- you qualify for unemployment

I have not read all of this but what I was told by my previous employer (because they had to hire someone back they fired) Was that If someone puts in enough time on the job and gets fired.. applies for unemployment that the employer has a choice. They can either sign off and pay the unemployment or offer the employee their job back. If the employee turns the job down then they are also turning down unemployment.

I didnt read or vote.. but.. will they not let you take maternity leave? When I left my last job I put in my 2 weeks but asked to be let go soon as they could replace me, for medical reasons..

I'm only going on 20 weeks so not sure where or if maternity leave falls into this. Also to everyone above I'm not worried about unemployment it's no where near my list of priorities.

If your doctor fills out paperwork it can count for 20 weeks on.. if it is medically neccesary for you not to work right now. There are extended leaves.

Well, I dont mean paid leave either.. But if they value you as an employee and they already know your medical needs for this pregnancy.. They may be more likely to put up on a hiatus of sorts? The way I see it, its a win win.. Your work needs someone they can count on and you need to have the freedom to go to appts at the drop of a pin.. etc. kwim? I would talk to your employer directly and honestly.. Say "I'm happy to stay as long as you need me, I just dont know how much use I will be under my current condition with this pregnancy."

The way I see it, its a win win.. Your work needs someone they can count on and you need to have the freedom to go to appts at the drop of a pin.. etc. kwim? They let me off for 2 weeks med leave (already) and never give me problems about my appointments or the docs ordering me out of work, but currently we are managing to lose money not make money off of me working because I'm absent so much due to the pregnancy, and it's not equalling the expense paid for me to work. Plus adding on I usually can't drive home from the hospital myself (they won't let me go unless I have someone to take me) and then having someone to pick up adah if I'm there (which will be an issue when D leaves for work ups. Which is why we decided for me to put in my two weeks. Today when I put it in they offered me maybe the position of part time as well as more desk positions, but even that's no guarantee it will keep me out of the hospital since the condition I have will exist wether I work or not.

Couple of things, all random... If someone is terminated, it doesn't necessarily mean they will be unable to collect unemployment. If a person is terminated, there is a hearing to decide if the former employee qualifies for unemployment or not. It is not illegal to terminate someone if they are unable to perform their job. It IS illegal to terminate someone "just because they are pregnant". If someone is pregnant and still able to perform their job, then they can't legally be terminated. However, NC is a "work at will" state. A person can be terminated for any reason, or no reason at all. In order to collect unemployment, a person needs to be ready, willing and able to work. Family Medical Leave Act allows for up to 12 weeks of paid or unpaid leave (up to the employer) annually. Like I said, all random, but hopefully helpful. (I was an employer in NC for 15 years - had been an employer for over 22 years total)

I read all the above online. I'm not worried about compensation. I wasn't actually worried if they did or didn't fire me, just a random poll. Hah.

So good news. I wasn't terminated. I was given the option to not complete my two weeks and to just give them a resignation letter. And I was also told at any point after the pregnancy if I would like to return to the practice I can.
